Client-Commissioned Work
For custom design projects:
- Final Approved Designs: Copyright transfers to the client upon full payment
- Usage Rights: Client receives exclusive rights to use the final designs for their intended business purposes
- Commercial Use: Client may use designs for commercial purposes as outlined in the project agreement
- Modifications: Client may modify final designs or hire others to do so
PixelAura Retained Rights
- Source Files: Original design files and working documents remain PixelAura property unless specifically transferred
- Unused Concepts: Rejected or unused design concepts remain PixelAura property
- Portfolio Rights: Right to display completed work in portfolios, case studies, and marketing materials
- Process Documentation: Behind-the-scenes content and process documentation
Trademark Considerations
Logo and Brand Identity Design
- PixelAura creates original designs but does not conduct trademark searches
- Clients are responsible for trademark research and registration
- PixelAura is not liable for trademark conflicts or infringement claims
- Clients should consult trademark attorneys for legal advice
Trademark Registration Support
While PixelAura does not provide legal services, we can:
- Provide design files in formats suitable for trademark applications
- Create variations and specifications as needed for registration
- Refer clients to qualified trademark attorneys
- Adjust designs based on trademark attorney feedback
Client Responsibilities
Content and Materials
Clients must ensure that all provided materials:
- Are owned by the client or properly licensed
- Do not infringe on third-party copyrights or trademarks
- Include proper attribution when required
- Comply with applicable licensing terms
Indemnification
Clients agree to indemnify PixelAura against claims arising from:
- Use of client-provided materials
- Trademark or copyright infringement by client-provided content
- Client's use of final designs beyond agreed scope
- Modifications made to designs after delivery
Third-Party Content
Stock Images and Assets
- Stock images require separate licensing by the client
- PixelAura may recommend stock image sources but does not provide licenses
- Custom photography and illustrations are included in project scope when specified
- Clients are responsible for ongoing licensing fees for stock content
Fonts and Typography
- Commercial font licenses are the client's responsibility
- PixelAura will specify font requirements and licensing needs
- Alternative fonts may be suggested for budget considerations
- Web font licensing is separate from desktop font licensing
PixelAura Intellectual Property
Company Branding
- "PixelAura" name and logo are protected trademarks
- Unauthorized use of PixelAura branding is prohibited
- Clients may reference PixelAura as their design partner with permission
- Portfolio pieces may include PixelAura attribution
Design Methodologies
- PixelAura's design processes and methodologies are proprietary
- Templates and design systems remain PixelAura property
- Clients receive final outputs but not underlying systems
- Training materials and documentation are confidential
Usage Limitations
Scope of Use
Client usage rights are limited to:
- The specific business entity named in the project agreement
- The intended use cases outlined in the project scope
- The geographic regions specified (if any)
- The time period agreed upon (if applicable)
Prohibited Uses
- Reselling or licensing designs to third parties without permission
- Using designs for purposes not specified in the original agreement
- Claiming authorship or creation of the designs
- Reverse engineering or recreating PixelAura's design processes
Copyright Infringement Claims
DMCA Compliance
PixelAura complies with the Digital Millennium Copyright Act (DMCA). To report copyright infringement:
